These terms are an agreement between you and HSLA0001 Inc. (“HSLA0001”, “we”, “us”). They cover SOHO: the iPhone app SOHO - Personal Shopper, the website sohoai.app, and the service behind them (together, “SOHO”). SOHO and SOHO - Personal Shopper are products of HSLA0001 Inc. By creating an account or using SOHO you agree to these terms and to the privacy policy. If you don’t agree, please don’t use SOHO.

SOHO is new

SOHO is new and still changing. Features may change, break or go away, it will make more mistakes than a finished product, and we may limit how much you can use it, for example with a daily message limit. SOHO is free today. If that changes, we’ll tell you before you’re charged anything. Please tell us when something goes wrong: support@sohoai.app.

Your account

You sign in with Apple. You’re responsible for what happens in your account, so keep your Apple ID and your iPhone secure, and tell us if you think someone else has used it. One account per person.

What SOHO does

SOHO recommends products, suggests sizes, watches prices and stock, and, when you approve, takes you to the brand’s checkout. Its suggestions come from an AI model working from public product pages, brand size charts and what you’ve told it. It can be wrong: about fit, about whether something suits you, about price, about stock. What it tells you is information, not professional advice, and the decision to buy is always yours. Check the product page before you buy.

SOHO’s AI

SOHO runs on AI from other companies, and using it means sharing with them. To answer you, SOHO sends what you tell it, including your messages, photos, sizes and measurements, to Anthropic, whose Claude model writes SOHO’s replies. When SOHO talks, the words of its reply go to ElevenLabs to become its voice. Neither company uses any of it to train its models. You agree to this when you create your account or sign in, on the screen where you do; the privacy policy says more, and you can delete your account at any time.

Prices are approximate

Prices in SOHO are estimates. When a shop sells in another currency, SOHO converts its price to yours using recent exchange rates, and the price it shows can differ from what you pay because of the rate on the day, your card’s conversion, duties, taxes or shipping. Retail prices, “under retail” and savings are SOHO’s estimates too. The total in the shop’s checkout is the price you pay.

Buying

SOHO never buys anything without your approval. When you buy, you buy from the brand, in the brand’s own checkout. Their prices, taxes, shipping, returns and warranties apply, and they’re responsible for your order. Prices and stock can change between when SOHO shows you something and when you check out. HSLA0001 isn’t the seller of any product and isn’t affiliated with the brands SOHO shows you unless it says so.

Shops and other sites

SOHO links to shops and other sites we don’t control. We aren’t responsible for their content, products, prices, availability, privacy practices or terms, and what happens between you and them is between you and them. Shops and affiliate networks may pay HSLA0001 a commission when you buy through a link in SOHO. That never changes the price you pay, and SOHO doesn’t choose or rank what it shows you by commission.

Brands and products

Brand names, product names, logos, photos and descriptions in SOHO belong to their owners. SOHO shows them to identify the products it finds for you and to send you to the shops that sell them. Showing them doesn’t mean a brand or shop endorses SOHO or works with us. If you own something SOHO shows and want it changed or taken down, write to support@sohoai.app and we’ll act on it promptly.

For a copyright complaint, include: the work you say is infringed; where it appears in SOHO; your name, address, phone and email; a statement that you believe in good faith the use isn’t authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that your notice is accurate and that you’re the owner or authorized to act for them, with your physical or electronic signature. We remove what we should, and close the accounts of people who repeatedly infringe.

Your part

• You’re 18 or older, or 16 or older with a parent’s or guardian’s permission.
• You only send photos you have the right to share, and you don’t send photos of other people without their permission.
• You don’t use SOHO to break the law, harass anyone, or try to break, overload, scrape or reverse-engineer the service.
• You use SOHO for your own shopping. You don’t resell it, share your account, get around its limits or security, access it with bots or scripts, or use SOHO, what it produces or its data to build or train a competing product or model.
• You don’t pretend to be someone else, or to be SOHO or HSLA0001.
• You’re not in a country under a U.S. government embargo or designated as supporting terrorism, and you’re not on any U.S. government list of prohibited or restricted parties.

Your content

What you send SOHO stays yours. You let us store and process it to run SOHO, as the privacy policy describes. You can download it or delete it at any time from Settings.

SOHO belongs to HSLA0001

SOHO and SOHO - Personal Shopper are products of HSLA0001 Inc. HSLA0001 owns SOHO and all rights in it: the app, the website and the service, their software, design, text and graphics, and the names SOHO and SOHO - Personal Shopper and the SOHO wordmark, which are trademarks of HSLA0001 Inc. We give you a personal, limited, non-exclusive, non-transferable license, which we can revoke, to use SOHO for your own shopping while you follow these terms. Nothing here gives you any other right in SOHO or in our names and marks. Don’t use them without our written permission, and don’t present anything as made by, or connected with, SOHO when it isn’t.

If you send us ideas, suggestions or feedback, we may use them however we like, without owing you anything.

The service

We work to keep SOHO running and accurate, and we may change or stop features; we’ll tell you in the app before anything that affects you significantly.

To the fullest extent the law allows, SOHO is provided “as is” and “as available”, and HSLA0001 disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and any promise that SOHO or what it tells you will be accurate, complete, available or error-free.

Liability

To the fullest extent the law allows, HSLA0001 isn’t liable for indirect, incidental, special, consequential or punitive damages, for lost profits, revenue, data or goodwill, or for purchases you make from brands and shops, and our total liability to you for any claim about SOHO is limited to the greater of what you’ve paid us for SOHO in the previous twelve months and US$50. Nothing here limits rights you have under consumer law that can’t be limited.

If someone makes a claim

If someone brings a claim against HSLA0001 because of how you used SOHO, because you broke these terms, or because you broke the law or someone else’s rights, you’ll cover our reasonable losses and costs from it, including legal fees, to the extent the law allows.

Ending

You can stop using SOHO whenever you like, and delete your account from Settings. We may suspend or close an account that breaks these terms, and if we ever shut SOHO down we’ll give you notice and a chance to download your data first. The parts of these terms that by their nature should last after your account ends do, including ownership, the disclaimers, liability, claims and governing law.

Apple

If you got SOHO from the App Store, these terms are between you and HSLA0001 Inc., not Apple. Apple’s standard Licensed Application End User License Agreement applies where these terms are silent. Apple isn’t responsible for SOHO, its content, maintenance or support, or any claims about it. Apple has no obligation to provide maintenance or support for SOHO. If SOHO fails to meet a warranty that applies, you can tell Apple, and Apple will refund what you paid for the app, if anything; Apple has no other warranty obligation for SOHO. Apple isn’t responsible for handling any claim by you or anyone else about SOHO, including product liability claims, claims that SOHO fails to meet a legal or regulatory requirement, consumer protection claims, or claims that SOHO or your use of it infringes someone’s intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Your use of SOHO must also follow the App Store’s terms.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Disputes about these terms or SOHO go to the state and federal courts located in New York, New York, and you and we agree to their jurisdiction. If you live somewhere whose consumer protection laws give you more rights, nothing here takes those away.

General

These terms and the privacy policy are the whole agreement between you and us about SOHO. If any part can’t be enforced, the rest still applies. If we don’t enforce something right away, we haven’t given up the right to. You can’t transfer these terms to anyone; we may transfer them to a company that takes over SOHO.

Changes

We may update these terms. If a change matters, we’ll tell you in the app before it takes effect, and using SOHO after that means you accept it.
